On 19 March 2024, Mariia Tsarova participated in a panel discussion on the future of investor-State dispute settlement (ISDS) as part of the Paris Arbitration Week.
The panel was part of the conference “Arbitration with State Entities at the Brink: What Lays Ahead?”, organised by Câmara Portuguesa de Comércio em São Paulo and Club Español e Iberoamericano del Arbitraje (CEIA-40) and hosted by Jus Mundi.
Mariia had the opportunity to discuss the evolution of the settlement of disputes between foreign investors and States, tracing its journey from diplomatic protection to the structured and globally recognized system of ISDS that we have today. She also spoke about the current challenges of ISDS within the European Union, focusing on the legal implications and effects of CJEU’s Achmea and Komstroy on intra-EU investment treaty arbitration, as well as the issues of enforcement of arbitral awards resulting from intra-EU investment arbitration. She also briefly outlined recent developments concerning the Energy Charter Treaty.
