Mohamed Shelbaya recently published a Note on Security Exceptions (ICSID Review)

Mohamed Shelbaya has published a Note in the ICSID Review on security exceptions in international investment agreements. The Note will appear in the next issue of the Journal in its paper format.

It provides an overview of the current landscape of security exceptions in international investment agreements and seeks to provide a framework for analyzing (i) the scope of security exceptions, (ii) their effect on both the applicability of a treaty’s substantive protections as well as its dispute resolution provisions, and (iii) the authority tasked with assessing their applicability and application (as between the Contracting States to the relevant treaty and a tribunal constituted thereunder).
