On 31 October 2023, Gaillard Banifatemi Shelbaya Disputes hosted the 2023 edition of the Gaillard Lecture that was delivered by Lord Neuberger of Abbotsbury. Following the first edition, which was held in Paris and delivered by Lord Hoffmann, this year’s Lecture was held in London, as the Gaillard Lecture will be an itinerant event that will move across the world much like the legal theory of its legendary namesake.
This year, Lord Neuberger, after a moving tribute to the legal thought and advocacy skills of Professor Gaillard, brilliantly analysed the role played by the concept of reasonableness under English law and contrasted it to the role good faith plays in civil law. He argued that, while common law and civil appear to follow very different paths and adopted differing analyses, in practice, the practical outcome to which they lead rarely differs.
